Contained herein are Anomaly`s Terms and Conditions of Use (“Terms”).
Please read them carefully before using the Anomaly’ (“Service”) as they affect your legal rights and obligations.
1. DESCRIPTION OF SERVICE AND ACCEPTANCE OF TERMS
Anomalys’ hereinafter referred to as (“Anomalys”, “we” or “us”) offers enterprise class trading application for individuals and businesses, such as Prop Firms, and private equity. Anomaly is a sophisticated trading tool designed to streamline to help traders with low capital gain access to more assets for their trading. By leveraging advanced technology and user-friendly interfaces, Anomaly empowers traders with efficient tools to monitor, analyze trades across their trading platforms from a single, centralized platform. (hereinafter referred to as “Service”), and will also include other features from 3rd parties, whose usage will be subject to their own terms and conditions. It is important to note that we are not responsible for the legal resources and materials available via such third parties. The term “Site” refers to points of access where you can view or access our services and includes our websites and applications. Devices such as smart phones and computers connected to access our Services will be collectively referred to as “Anomalys’ Devices” or “Devices”. “Payment Method” means the payment mechanism adopted by Anomalys’ to collect fees to its Service. By accessing our Services and Sites you accept and agree to these terms and are therefore bound by them. Further, by using this Service, you accept and agree that you are at least 16 years of age or of majority age and are fully capable and competent to enter into terms, conditions and obligations set forth in this agreement.
Anomalys’ has adopted a secured method of storing and managing your Trading accounts, broker, broker password and other data. Subscribing to our service enables us to easily manage your multiple trading accounts, for which we have reasonably provided adequate data privacy security.
2. REGISTRATION AND SUBSCRIPTIONS
2.1 Anomalys’ Services are intended for traders from individual/solo practices to medium and large practices. As a trading application, the architecture is robust enough to accommodate different sizes of trading accounts that we offer.
2.2 Upon registration, we may ask you to provide information about yourself such as your name, physical location address, and contact information (such as your email address or your phone number and billing information). We require that the details be correct and up to date. If we have reason to believe that the information provided is false, incorrect or obsolete, we have the right to refuse or deny you access to our Services.
2.3 We offer an option to create a profile and subsequently configure the service for your Practice/Company. These configuration is required for you to effectively and efficiently maximize the application’s utility.
2.4 Your registration with us will continue unless otherwise terminated by you or us.
3. BILLING AND PAYMENT
3.1 We charge a fee (inclusive of VAT) to use our Services, which forms the fees to our Service. We reserve the right to change the terms of our fees, including payment. We shall notify you of these changes and the changes shall be effective as of the next account purchase following the date of change.
4. PAYMENT METHOD
Upon registration, you will be required to provide one or more Payment Methods accepted by Anomaly. Anomaly has adopted a Payment Processors for its Service, Taalent(a crypto payment platform). The Payment Processor available for your use depends on the geographic location you are connecting with the Anomaly from. Furthermore, you may update your Payment Method from time to time from your profile settings. We may suspend our Services if payment has not been effected due to insufficient funds, expiration or any other reason. Our Services will be restored once payment is settled. During your service suspension, you MAY NOT be able to use our Service. As stated hereinabove, you are responsible for additional charges such as VAT. You can also update your Payment Method, in which case, we shall continue to charge the relevant fee.
If you choose any account size, we advise to monitor your max allocation storage consumption to avoid any interruption in service in case you have fully utilized the package’s allocated space. You need to urgently request for your slot upgrade or additional slot storage to avoid interruptions or more slot space for adding more accounts.
4.1 FREE TRIALS
We currently do not offer free trials due to terms traders use both demo account and live accounts to earn, and Anomaly earns while you do. We can offer a live demonstrate of product or send you a pre-record video of product usage.
4.2 MAX ALLOCATION
We offer max allocation of $25,000 accounts max. Once you reach the maximum accounts you can purchase, you wont be able to purchase more.
5. USE OF ANOMALY SERVICE
5.1 The Services are intended for businesses ranging from individual/solo practices to medium and large enterprises. You should be at least 16 years of age to use our Service.
5.2 Anomaly Service is strictly for the use of the subscribed Traders only but can be used by non-traders who wants to earn(through the means of affiliates/affilication). You may not decoupling, deconstruct, copy, reproduce, distribute, publish, hacking into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Service. Additionally, no part of this Service may be distributed for sale or offer for sale. The Service provided via Anomaly is protected by copyright law and other intellectual property laws. Decompiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on this Service into a readable form in order to examine the construction of such software and/or to copy or create other products based (in whole or in part) on such software, is prohibited. Additionally, you may not transmit material devised to destroy, limit or interrupt the functionality of our software, hardware or any other equipment including viruses. You are also prohibited from using any facilities or resources to tamper with or compromise the security of our systems.
5.3 The Content accessed by our Service should not be relied on or advice e.g. medical and legal consultation. Content are strictly the opinions of the third party owners.
5.4 You will need compatible Devices to use our Service. These include Devices such as smart phones, tablets and desktops. Certain functionalities and features may differ depending on the Operating System of your Device and subscription.
5.5 To use our Service you need internet connection form an internet Service provider. You are responsible for the costs of your internet usage subject to terms provided by your internet Service provider.
5.6 From time to time you may be notified of the need to download an updated software. The update may also be automatic. The software updates are incorporated in these terms unless otherwise provided or directed.
5.7 You agree to use our Service in a manner consistent to the applicable laws, the terms and restrictions contained in this policy. We may terminate or deny you use of our Service if you do no abide by these terms, restrictions and applicable laws.
5.8 You agree to use our Service, we store your trading data to avoid data lose and analyse your trades once it is time for payout.
6. ANOMALY'S ACCOUNT, PAYMENT DETAILS AND PASSWORD
The Account owner is responsible for their Anomaly account. They should always keep their account details and Payment Method confidential, and not disclose their password to anyone. Any actions performed on the account by another person will be treated as if they were done by the account owner or with their approval.
7. TRADEMARKS
trademarks of Phace Company Ltd. As such, none of our trademarks should be copied or utilized.
8. UNREQUESTED SUBMISSIONS
We do not accept unrequested submissions such as designs, codes, designs, among other submissions. Any similarity between such unrequested submissions and our works are therefore purely coincidental.
9.0 ELECTRONIC COMMUNICATION
We may communicate to you about our Services or Terms electronically through email or through our Sites. You agree to receive electronic communication form us and that such communication satisfies any applicable legal communication requirements.
10. DISCLAIMER OF WARRANTIES, LIMITATION OF LAIBILITY AND INDEMNITY
10.1 The use of Anomaly Service is at your own risk. This Service, including Content, software and all other material is provided “as is” and “as available” therefore there will be no warranties of any kind, either express or implied, to the fullest extent permitted by law. Our Service may not be free of error or inaccuracies. We do not make any warranties or representation regarding the use of the Service, including but not limited the Content, material, software, facilities and information connected to this Service.
10.2 We and our affiliates do not accept any liability for any loss or damage, whether direct, indirect, coincidental or otherwise resulting from use or inability to use this Service including material, facilities, information, software and Content on this Service.
10.3 You agree to indemnify us and our affiliates from, and hold us and our affiliates harmless against any all liabilities, claims, damages and expenses or any other loss related in any way to your breach of these terms or any unlawful commission or omission.
11. DISPUTE RESOLUTION
If you have an issue regarding our Service you can contact our customer care Services for resolution of disputes at support@anomalyforex.com. If you are not satisfied with the solution, we agree to solve this dispute through arbitration per the arbitration laws of the Lagos State, Nigeria. You agree that you waive your right to litigate a dispute in court. Further, arbitration will take place on individual basis and class actions are not permitted. If a dispute is not filed within a year, then it shall be time barred and cannot be pursued.
12. SEVERABILITY
If any provision shall be held unlawful, void or unenforceable for one reason or another, this shall not affect the enforceability of the remaining provisions.
13. FORCE MAJEURE
We shall not be liable for reason of being unable to perform our obligation if the failure is occasioned by force majeure. Such events include, but are not limited to, act of God, epidemic, war, government action or any other unforeseeable circumstances beyond our control.
14. GOVERNING LAW
These Terms of Use shall be governed by, construed and enforced in accordance to the laws of the Lagos State, Nigeria.
15. CHANGES TO THESE TERMS
We may make changes of these terms from time to time for various reasons. Changes of these terms will be communicated to you at least 30 days before such changes apply. If you do not agree to these changes, you must end your Subscription with Anomaly.
